Henry County Board of Elections Special Meeting 12/22/20

  • City attorney Johnson was present to clarify the law and he stated 9,271 voters were listed as having put in a change of address request. The challenger alleged this was proof that these voters did not reside in Henry County.
  • Board member Crumbley proposed that the challenge be accepted because she knows the two people who provided the list and trusted them. She also stated that voters should have the burden of proof. Chair Ameka Pitts corrected Crumbley stating that the challenger has the burden of proof, not the voter. There was more discussion about whether the information was correct or up-to-date as well as whether they may have been temporary address changes. The challenger provided no additional information to make that determination.
  • The Chair, Dr. Donna Morris-McBride then stated her position that there was insufficient information or evidence to support a probable cause and moved to dismiss the challenge. Arch Brown seconded the motion.
  • The Board dismissed the voter challenge by a 3-2 vote.  Mildred Schmelz and Arch Brown voted in favor of the motion to dismiss. Calloway and Crumbley voted against the dismissal of the voter challenge.
