State Board of Elections Meeting 02/24/21

SEB 2018-055 Forsyth Co (provisional ballots). Recommendation: refer to AG. Board action: sent to AG.

SEB 2018-061 Fulton Co (Voter registration UOCAVA) Two postcard applications erroneously rejected; applications sent after SOS intervened. Recommend: letter of instruction. Board action: letter of instruction to Fulton Co BOE.

SEB 2018-062 Fulton Co (vote buying) Investigation found South Fulton Solicitor reduced citations $50 if individuals receiving them voted. Recommend: Send to AG. Board action: bound to AG.

SEB 2018-068 City of Woodland (early voting procedures) Investigation found they opened polling area late and had unlocked drop box. Recommend: Send to AG. Board action: Sent to AG.

SEB 2018-073 Effingham Co (UOCAVA ballot) Ballot not issued until registration application was out of pending status, which occurred on a weekend. Recommend: letter of instruction. Board action: letter of instruction.

SEB 2018-074 Fulton Co (prohibited cell phone) two individuals used cell phones after told not to use them. Respondent Aaron Johnson disputed facts about his wife, one of the accused, saying she put her phone away when told to. Recommend: Send to AG. Board action: Sent to AG for both individuals.

SEB 2018-077 Clayton Co (write-in list of candidates) write-in candidate list didn’t include one of the candidates; it was corrected after the omission came to election staff attention. Respondent Charles Reed, county attorney, said they took corrective action immediately and implemented safeguards to avoid future reoccurrences. Recommend: Send to AG. Board action: letter of instruction to BOE.

SEB 2018-079 Hancock Co (absentee ballot) 200 ballots not mailed within three days of receiving applications. Respondent: Agrees with the finding, but said a staff person was in an accident and no other staff were available to handle the requests. They said training of additional staff to handle requests has been given.  Recommend: send to AG. Board action: letter of instruction to staff person involved and send complaint against BOE to AG. 

SEB 2018-082 Coffee Co (tabulation) Elections staff failed to upload a flash drive until day after election; the flash drive information was uploaded before certification. Respondent: County attorney agreed with the findings, but said they have figured out how to deal with it in the future. Recommend: send to AG. Board action: letter of instruction.

SEB 2018-83 Pulaski Co (interference with electors) There was a complaint 34 voters got inappropriate assistance. The investigation found three possible violations: one in which campaigning took place within 150 feet of the polling area and two where inappropriate assistance was given to voters in the polling area. Recommend: send to AG. Board action: Sent to AG.

SEB 2018-085 Fulton Co (poll worker conduct) Poll workers advised voters on who to vote for. Respondent: Fulton Co representative asked that the board of elections not be included in the sanction but admitted poll worker misconduct. Recommend: send to AG, including poll worker and board of elections as responsible parties. Board action: sent report on poll worker to AG, dismissed charge against board of elections.

SEB 2018-116 Gwinnett Co (absentee ballot tabulations) Six separate cases were presented where absentee ballot requests were mishandled by elections staff. Respondent: Argued in each case to give letter of instruction, saying each was due to worker error and they were corrected. Recommend: send to AG. Board action: sent to AG.
